Maintenance Mediation Pilot Scheme
Background of the Pilot Scheme
Resolving disputes related to divorce and maintenance are not easy. Parties involved in maintenance payment disputes might contest the matter in court for dispute resolution. Mediation is an effective alternative way to resolve disputes other than court proceedings. In this regard, the Home and Youth Affairs Bureau launches a three-year Maintenance Mediation Pilot Scheme (Pilot Scheme) through the Community Care Fund, appointing the Hong Kong Family Welfare Society to provide mediation services on maintenance to separating or divorcing persons, so as to assist both parties to resolve related disputes through mediation.


Beneficiaries and Eligibility
Participation in the Pilot Scheme is on a voluntary basis. The Pilot Scheme provides mediation services on maintenance to separating or divorcing persons(including maintenance payers and payees).
Parties involved in maintenance payment disputes are eligible to apply for the Pilot Scheme free of charge provided that one of the parties (applicant) is a Hong Kong resident and meets the following criteria.
The applicant is a recipient of the Comprehensive Social Security Assistance (CSSA) Scheme; or
The applicant is a full-rate allowance recipient of the Working Family Allowance Scheme; or
The applicant is a full-level assistance recipient of Student Financial Assistance Schemes (including the School Textbook Assistance Scheme / the Student Travel Subsidy Scheme / the Subsidy Scheme for Internet Access Charges); or
Applicant not meeting criteria (1) to (3) above but belongs to a low-income family, that is, himself/herself and the household members residing with him/her earn a monthly household income of no more than the specified income limit applicable to the corresponding household size:(Please refer to the table below)

Scope of Mediation
The Pilot Scheme provides mediation services on maintenance to people in need. During the process of mediation for maintenance disputes, various divorce-related issues may be involved.
Such as:
-
separation arrangements
-
custody
-
matrimonial home
-
arrangement for property distribution
Therefore, mediators will also assist in mediating other divorce-related issues in parallel to the maintenance mediation process to hopefully achieve the best mediation results for both parties.
